Is it illegal to sell “autographed” Celebrity photos if they are fake?

Say someone bought what they thought was a genuine framed photograph of a celebrity at a tag sale and later discovered it was just a laser print job, is the seller liable, or is the buyer just stupid? What if the seller didn’t know? Should the seller have put a disclaimer on the item?

It’s only illegal if you haven’t the rights to sell it. So if you mailed (let’s say tom cruises manager), and you make a deal about he shall get a signed photo for your daughter. Then it’s legal because he’s manager and tom cruise own the rights to make these. But if you walk out the street and some random guys offered you this it would be illegal cause he doesn’t own these rights.
